The Terms and Conditions contained herein (“Official Rules”) shall apply to and govern the Cynosure, LLC (“Sponsor”), located at 5 Carlisle Way, Westford, MA 01886, Cynosure Lutronic Academy 2026 XERF Before + After Contest. NO PURCHASE NECESSARY TO ENTER OR WIN. Contestants agree to be bound by these Official Rules. VOID WHERE PROHIBITED BY LAW. Federal, state, and local laws and regulations apply.
The XERF Impact Contest begins August 31st, 2026 at 12:01am Eastern Time and ends October 1st, 2026 at 11:59pm Eastern Time. By submitting an entry, each contestant agrees to the rules of the contest and states that he or she is 18 years old or older.
This contest is open to entrants who are 18 years old or older. Employees, officers, directors, and agents of the Sponsor and its parent companies, subsidiaries, affiliates, advertising and promotion agencies, and their immediate family members and/or those living in the same household are not eligible to participate. The Sponsor will determine winners’ eligibility in its sole discretion. This contest is open to customers who are legal residents of the fifty (50) United States and the District of Columbia. Customers may only submit Photos of patients who have provided prior written consent authorizing the use of their photographs for the purposes contemplated by these Official Rules and the Licensing Agreement, in compliance with all applicable privacy laws and regulations, including HIPAA where applicable.
Entrant must complete the following during the Entry Period. Limit one (1) entry per person, and one (1) entry per practice or location:
Reply to Sponsor’s “Share Your XERF Success Story” email with a written submission (an “Entry”) describing, in the entrant’s own words: (i) the approximate revenue generated using XERF and the timeframe in which it was generated; and (ii) the impact XERF has had on the entrant’s practice, which may include new patients, patient demand, successful events, practice growth, or other outcomes.
The Entry must comply with the following requirements: (i) the Entry must be entrant’s own original work, describing entrant’s own experience, and must not have been previously submitted to any other contest or competition; (ii) the Entry must not contain any patient-identifiable information or protected health information; (iii) the Entry may not contain, mention, refer, or otherwise allude to any material that is violent, lewd, obscene, sexually explicit, pornographic, disparaging, defamatory, libelous, racially or morally offensive, or otherwise contain inappropriate content or objectionable material; (iv) the Entry cannot promote alcohol, illegal drugs or tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any political agenda or message; (v) the Entry cannot in any manner defame, misrepresent, contain disparaging remarks, or reflect negatively about Sponsor, its products, or other people, products, or companies or their products, or in any way reflect negatively upon such parties or explicitly or implicitly communicate messages inconsistent with the positive images and/or goodwill with which Sponsor wishes to be associated, as determined by Sponsor in its sole discretion; (vi) the Entry cannot itself be in violation of any law; and (vii) the Entry must otherwise be in compliance with these Official Rules. Sponsor reserves the right, in its sole discretion, to disqualify any Entry that Sponsor believes does not comply with or is in violation of these Official Rules or that otherwise contains prohibited or inappropriate content.
Winner will be selected at Sponsor’s sole discretion. Submissions may be based or evaluated on the following non-exhaustive criteria, among other factors Sponsor deems relevant. Winner will be selected based on merit, using the objective judging criteria set forth below (the “Rubric”). Each eligible Entry will be reviewed and scored by Sponsor’s judges for a total of up to 100 points, as follows:
The Entry (or Entries) receiving the highest score(s), as determined by Sponsor’s judges in Sponsor’s sole discretion, will be selected as the winner(s). In the event of a tie, Sponsor will select the winner in its sole discretion based on the Rubric. Sponsor’s decisions are final and binding on all matters relating to this Contest.
Sponsor will select the winner as described herein. The winner will receive one (1) box of XERF tips (approximate retail value (“ARV”): $2,500). Winner will be notified via email no later than October 4th, 2026 at 11:59pm Eastern Time. Potential winner is subject to verification of eligibility and compliance with these Official Rules. All federal, state, and local taxes on the prize are the sole responsibility of the winner. Prizes are non-transferable, and no substitution will be made except at Sponsor’s sole discretion. The potential winner must respond within 72 hours, or the prize will be forfeited, and another potential winner will be chosen.
Participation in the Contest requires the collection of your name, practice name, email address, and submitted written materials. All submissions, regardless of winner determination, may be used for Sponsor’s marketing purposes, subject to the terms of the Licensing Agreement and applicable patient consents. By entering, each entrant grants Sponsor a perpetual, irrevocable, worldwide right to use entrant’s name, likeness, and biographical information for advertising and promotional purposes in any media without additional compensation, except where prohibited by law.
These Official Rules shall be interpreted in accordance with and governed by the laws of the Commonwealth of Massachusetts. By entering, each entrant agrees that Sponsor and its affiliates, officers, directors, employees, and agents shall not be liable for any claims, damages, or losses of any kind arising out of or in connection with the contest or any prize awarded, including without limitation direct, indirect, incidental, consequential, or punitive damages. These Official Rules, in addition to the Licensing Agreement, represent the entire agreement between Sponsor and each entrant regarding the subject matter hereof and supersede any and all prior and contemporaneous agreements, whether written or oral, regarding the subject matter hereof. Sponsor reserves the right to modify or amend these Official Rules at any time, with notice to entrants where practicable.
Sponsor, in its sole discretion, reserves the right to cancel, suspend, or modify this promotion at any time, including if Sponsor becomes aware of any occurrence which would materially affect the promotion’s security or fairness, including but not limited to technical malfunction of the contest website, software and/or hardware malfunctions, transmission failures, and virus contamination, unauthorized intervention, fraud, pandemic or public health emergency, natural disaster, government order or regulation, venue unavailability, acts of terrorism, labor disputes, or any other cause beyond Sponsor’s control. In such event, Sponsor may, in its sole discretion, select winners from among all eligible entries received prior to such action. By entering, each entrant agrees to release Sponsor and its affiliates, officers, directors, employees, and agents from any liability, claims, or damages arising from or related to any such cancellation, suspension, or modification.
